Explainer · Rent Agreement

You have found a flat, agreed the rent, and now the landlord says, "Let us make a rent agreement." Which format should you use, how long should it run, and does it need stamp paper or registration? A rent agreement is a contract between landlord and tenant that sets the rent, deposit, duration and terms. Most are made for 11 months to avoid mandatory registration, and should be on stamp paper or e-stamped. This guide gives you the clauses, the rules and a sample, last verified October 2026.

The short answer
  • What it is: a contract between landlord and tenant on rent, deposit, duration and terms.
  • 11-month rule: leases above one year must be registered under the Registration Act, 1908, so most homes are rented for 11 months. Some states have extra rules.
  • Stamp duty: state-wise. Use stamp paper or an e-stamp, and confirm the current rate for your state.
  • Notarised is not registered: notarising does not replace stamp duty or required registration.

01Why the format of a rent agreement matters

Most rent disputes in India begin with a weak or missing agreement. The deposit is not returned, the rent is raised without notice, the tenant stays on after the term, or the landlord enters the flat without warning. In each case, the first question is the same: what did the paper say?

A rent agreement is only useful if it is clear, complete and properly stamped. An unstamped or under-stamped document can be refused as evidence until the duty and a penalty are paid. So the format is not a formality. It decides how well you are protected if something goes wrong.

People search for this under many names: rent agreement format, rental agreement format, lease agreement format, rent agreement in Word, and rent agreement in Hindi. They all mean the same thing, a usable template. In simple terms, a lease usually means a longer term, and a leave and licence means permission to use the premises without transferring an interest in them. The sample below works for a normal residential rent.

02Essential clauses in a rent agreement

Whatever template you use, make sure these eight points are covered in plain words.

  • Parties: full names, father’s or spouse’s name, addresses and ID details of the landlord and the tenant.
  • Premises: the full address of the property, with details such as floor, area and fixtures included.
  • Rent: the monthly amount, the due date, the mode of payment, and any yearly increase (for example, a fixed percentage after each year).
  • Security deposit: the amount, whether it earns interest, when it will be returned, and what can be deducted for damage or unpaid dues.
  • Term: the start date, the end date, and how renewal works.
  • Maintenance and bills: who pays society charges, electricity, water, and who handles minor repairs and major repairs.
  • Termination and notice: how much notice each side must give, and what happens if the notice is not given.
  • Lock-in period: a fixed period (for example, the first few months) during which neither side can end the agreement without penalty.

Good agreements also cover permitted use (residential only), subletting (usually not allowed), inspection rights, handing back the premises, and which court or city will hear a dispute. Keep each clause short. If a clause is vague, a court will read it against the person who drafted it in many cases, so be specific.

A rent agreement does not need heavy legal words. It needs the right eight points, written clearly, on the right paper.

03The 11-month rule and when registration is mandatory

You will see "11-month rent agreement" everywhere. The reason comes from the Registration Act, 1908. Section 17 says that a lease of immovable property from year to year, or for any term exceeding one year, or reserving a yearly rent, must be registered.

An agreement for 11 months, with rent fixed monthly, does not exceed one year and is not a year-to-year lease. So registration is not compulsory under that section. This saves both sides the time and cost of registration, and that is why most residential rent agreements are made for 11 months and then renewed.

When registration is mandatory

  • When the term is more than one year, or the lease is year to year, or the rent is fixed as a yearly rent.
  • When a state law or rent act requires it, whatever the term. Some states ask for registration or intimation of rent agreements even for short terms.

Because of this, always check the rule of your own state. An agreement that is longer than a year and not registered may not be admissible to prove the lease, though it may still be used for limited purposes such as showing the nature of possession.

A common trap

Renewing an 11-month agreement again and again does not by itself make it a registered lease, but a long chain of renewals in some states can raise questions. If you plan to stay for several years, ask whether a registered lease is safer.

04Stamp duty and e-stamp on a rent agreement

Stamp duty on a rent agreement is a state subject. That means the rate, the way it is calculated and the minimum amount differ from state to state. In some states it is a flat amount for short rentals. In others it is a percentage of the annual or total rent, sometimes with the deposit added in.

Many states now offer e-stamping. You pay the duty online or at an authorised centre, and get an e-stamp certificate with a unique number that can be checked. Others still use physical stamp paper, bought from a licensed vendor. Either way, the agreement should be printed or attached to the stamp paper, and both parties should sign it.

How to find the right amount

  • Check the stamp duty page or the revenue department site of the state where the property is located.
  • Note how your state treats rent, deposit and term when it works out the duty.
  • If the agreement is registered, add the registration fee, which is also set by the state.

Do not copy a duty figure from another state or from an old blog. Rates change often. Confirm the current rate before you buy stamp paper.

05Registered agreement vs notarised agreement

People often think a notary stamp makes an agreement fully valid. It does not work that way.

PointNotarisedRegistered
What it provesThat the signatures were made before a notaryThat the document was executed and recorded with the Sub-Registrar
Stamp dutyStill needed on the agreementNeeded, plus a registration fee
Where it is doneBefore a notary publicAt the Sub-Registrar office, often with an appointment
Needed by lawNot by itselfMandatory for leases above one year and where state law says so
Typical useShort residential rent of 11 months or lessLonger leases and commercial leases

For a standard 11-month home rental, a stamped and signed agreement, with witnesses, is common practice. For a long lease or a commercial property, registration is the safer path and is often required.

Use this as a starting point, and fill in the blanks. Print it on the right stamp paper or attach the e-stamp certificate. Have it checked by a lawyer if the property is valuable or the terms are unusual.

07Common mistakes to avoid

  • Using plain paper: the agreement may not be accepted as evidence without proper stamp duty.
  • Buying stamp paper of the wrong state: duty is paid for the state where the property is.
  • Leaving out the deposit terms: say when and how it is returned, and what can be deducted.
  • No notice clause: without it, an exit becomes a fight about timing.
  • Skipping the inventory: list fans, geysers, furniture and their condition at move-in.
  • Ignoring local law: some states have rent acts with extra rules on registration and eviction.

08Where Claw fits

Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.

For rent agreements, Claw can help in two honest ways. First, its AI drafting and contract templates can help an advocate or legal team prepare an agreement faster, with a clause library and version control. You still need to confirm state stamp duty and registration rules yourself. Second, if a rent or eviction dispute reaches court, Claw’s case management can track the case, hearing dates and cause lists, and send WhatsApp and email alerts. Claw has a free plan for individual advocates, and paid plans for teams. Claw does not use customer case documents to train AI models.

Claw is not a stamp paper or e-stamp service, and it does not replace legal advice on your specific property.

10Frequently asked questions

What is a rent agreement?

A rent agreement is a written contract between a landlord and a tenant that sets the rent, security deposit, duration and terms of use of a property. Most are made for 11 months and should be on stamp paper or e-stamped.

Why are most rent agreements made for 11 months?

Under Section 17 of the Registration Act, 1908, a lease for more than one year must be registered. An 11-month agreement avoids that requirement in most cases. Some states have their own rules, so check your state.

Is stamp duty the same in every state?

No. Stamp duty on a rent agreement is state-wise. The rate and method differ, so confirm the current amount with your state stamps or revenue department before you buy stamp paper.

What is the difference between a notarised and a registered rent agreement?

A notary only attests the signatures. Registration records the document with the Sub-Registrar and is mandatory for leases above one year and where state law says so. Stamp duty is needed in both cases.

Can I make an e-stamp rent agreement?

In many states, yes. You pay the duty online or at an authorised centre and get an e-stamp certificate, then print the agreement on it or attach it. Check that your state supports it for rent agreements.

Where can I get a rent agreement format in Word or Hindi?

Copy the sample on this page into a Word file and edit the blanks. For Hindi, get the translation checked by a lawyer so that no clause changes in meaning.
