How to manage a patent portfolio in India without missing a deadline: the InPASS and status workflow, the annuity and compliance clock, and when you need more than a spreadsheet.

A patent portfolio does not fail because the invention was weak. It fails because a fee was paid late, a reply to the examiner was missed, or nobody noticed a competitor opposing the grant. Indian patents run on a long chain of dated steps, and each step has its own form and its own window. This guide explains how to manage a patent portfolio in India, the workflow that keeps every deadline visible, and how to decide when a spreadsheet is no longer enough. Last verified October 2026.

The short answer
  • The core habit: one master list, checked against the IP India record every month, with one dated action per patent.
  • Key dates: examination request within 31 months (2024 rules), post-grant opposition within 12 months of grant publication, annual renewal from the third year, Form 27 every three financial years.
  • Global portfolios: use a specialist docketing service alongside any India tool.
  • India registry plus courts in one place: Claw, bundled in Premium at Rs 10,999 per year (excl GST).

01Why patent portfolios slip in India

Patent portfolio management means knowing, for every patent and application you own, what stage it is at and what must be done next, and by when. In India that is harder than it looks, for three reasons.

Every patent has its own clock

Each application has a different filing date, priority date and grant date. So each one has a different date for examination request, annuity and working statement. Ten patents mean ten separate calendars. A single missed date can lapse a patent or close a remedy for good.

The official status is in one place and the work is in another

The Indian Patent Office shows status online, but your instructions, invoices, drafts and emails sit elsewhere. If nobody checks the official record on a schedule, the file in your drawer and the record at the Patent Office slowly drift apart.

The risks are not only on the registry

A granted patent can be challenged by opposition, revoked in a petition, or asserted in an infringement suit. A portfolio that tracks only fees and ignores court activity is half a view.

02The InPASS, status and compliance workflow

The most reliable way to manage a patent portfolio is a fixed, repeating workflow with one owner and one record. Here is a version that works for a firm, a company or a university.

  1. Build one master list. For each patent or application, record the application number, title, applicant, filing date, priority date, the date of publication, the stage it is at, and the next dated action.
  2. Pull official status from IP India. Use the patent status search on the IP India public search portal for each application number. File and pay through the e-filing system, InPASS, which is also the place to see filed documents and fee receipts.
  3. Compare official status to your master list. Any difference (a new examination report, a hearing notice, a changed status) becomes a task the same day.
  4. Convert each next action into a dated task. Set a first reminder well ahead of the deadline, and a second reminder close to it. Give each task an owner.
  5. Check the annuity and compliance clock monthly. Look ahead 90 days for annuities, examination requests, replies and working statements.
  6. Watch for opposition and court activity. Track pre-grant and post-grant opposition on your own and rival patents, and track any court matter that names your patents.
  7. Record the outcome. Save the receipt, the order or the filed form against the patent, and set the next task.
Manage a patent portfolio by one rule: every patent has one next action, one date and one owner, checked against the official record every month.

03Component deadlines every Indian patent portfolio must track

These are the main dated steps under the Patents Act, 1970 and the Patents Rules, 2003 as amended. Always confirm the exact date for your own file, because extensions, fee changes and rule amendments apply.

StepTypical formDeadline or windowWhy it matters
Complete specification after a provisionalForm 212 months from provisional filing (Section 9)Missing it abandons the provisional.
Foreign filing statementForm 3Within 6 months of filing; update as foreign filings change (Section 8)Wrong or missing details can be used against the patent later.

Request for examinationForm 1831 months from the priority date or filing date, for applications covered by the 2024 amendment (Section 11B)No request means the application is treated as withdrawn.
Reply to the first examination reportReply with amendmentsReply period runs from the date of the report and can be extended, with an outer limit of 12 months under Section 21Missing it makes the application abandoned.
Pre-grant oppositionRepresentation under Section 25(1)After publication and before grantAnyone can file. You must be ready to answer it.
Post-grant oppositionNotice under Section 25(2)12 months from publication of grantA live threat to a freshly granted patent.
Annual renewal (annuity)Form 4 (renewal fee)Due before the end of each year, counted from the date of the patent, from the third year onward (Section 53 and Rule 80)A missed fee can lapse the patent.
Restoration of a lapsed patentForm 16Within 18 months of the lapse (Section 60)The last chance to revive a lapsed patent.
Working statementForm 27Once every three financial years, within 6 months after each period (Section 146 and Rule 131, as amended in 2024)Non-filing can attract penalty and risks a compulsory licence challenge.
PCT national phase entryForm 1 and related papersUsually 31 months from the priority date (Rule 20)Missing it ends protection in India.

Patent term is 20 years from the date of filing (Section 53). Fees differ for small entities, startups, individuals and other applicants. See the official fee schedule on the IP India website and the Act text on India Code.

04What good patent portfolio management looks like

A good system answers five questions for any patent, in under a minute.

  • Where is it? Current stage, matched to the official record.
  • What is next? One dated action, with an owner.
  • What did we pay? Annuities and fees paid, with receipts.
  • Is anyone attacking it? Opposition or court activity, caught early.
  • Can we prove it? Every filing and order stored against the patent.

Notice what is not on the list: a long feature menu. What matters is that dates are never held in one person’s head.

05Spreadsheet, specialist docketing or an all-in-one platform

There are three honest ways to run a portfolio. None wins on every row.

OptionGood atWhere it fits less wellCost model
Spreadsheet and calendarFree, familiar, fine for a handful of patentsNo official-status check, no alerts, fragile with staff changesNo licence cost
Specialist IP docketing (for example Anaqua, Clarivate, Dennemeyer, Iolite, JSK)Deep docketing, global annuities, high volume IP-firm workflowsBuilt for multi-country portfolios, and can be heavy for an India-only team. Usually demo or quote basedCheck each vendor, usually quote based
AI prior-art and patent analytics (for example PatSnap, Questel, IPRally)Prior-art and landscape searchSearch and analytics, not an Indian registry and court workflowQuote based
Technology transfer systems (for example Wellspring, Inteum)University and institution invention lifecycleLess focused on Indian court activityQuote based
All-in-one India IP and litigation platformRegistry tracking plus court tracking in one place, India-focusedNot a replacement for global multi-country annuity servicesBundled in a subscription

If your portfolio spans many countries, a global docketing specialist is usually the stronger fit. If it is mostly Indian, one place for registry and court matters is often simpler.

06How to choose

With fewer than about ten patents, a disciplined spreadsheet and the monthly workflow above can work. With a growing Indian portfolio, you need automatic reminders and a record of official status. With patents in many countries, add a global docketing specialist. If you also face opposition or litigation, pick a tool that sees court matters, not only fees.

07Where Claw fits

Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.

A portfolio that tracks only fees sees half the risk; the other half is court activity. Claw tracks cases, orders and hearings across 9,102 courts, benches and forums, searches 30 crore+ judgments with Supreme Court records from 1950 and High Courts from 1990, and returns results in under 5 seconds, so you can catch any suit or opposition that names a patent you own, or research how a court has read a similar matter. Claw does not use customer documents to train AI models.

Create a FREE Claw account to track patent litigation across your portfolio. To search the wider body of law, see case search across Indian courts.

09Frequently asked questions

How do I manage a patent portfolio in India?

Keep one master list of every patent with its stage, next action and date. Check each against the IP India record every month, and turn every deadline into a task with an owner. Track annuities, examination requests, replies and working statements.

What are the main deadlines for an Indian patent?

The main ones are the complete specification within 12 months of a provisional, the request for examination within 31 months for applications under the 2024 rules, post-grant opposition within 12 months of grant publication, annual renewal fees, and Form 27 every three financial years. Confirm each date against your file.

What is Form 27 and how often is it filed?

Form 27 is the statement of working of a patent in India. Under the 2024 amendment it is filed once every three financial years, within six months after the period ends.

Can I restore a patent that lapsed for non-payment?

Yes, in many cases, by applying under Section 60 using Form 16, within the allowed window and with the required fee. Check the current window before relying on it.

Do I need software to manage patents in India?

Not for a handful of patents. As the portfolio grows, or if you face opposition or litigation, software that tracks the registry and court activity reduces the risk of a missed date.

Does Claw track patent annuities and copyright registrations?

Claw tracks patent annuity and response deadlines, pending hearings and related tasks for Indian patents. It does not yet track copyright registration at the Copyright Office. For copyright it covers court matters only.
