EWS and Non-Creamy-Layer Affidavit Format (2026)
The self-declaration affidavit used to support an EWS or OBC non-creamy-layer certificate: the income and asset limits to check, a ready-to-use template, where to submit it, and the mistakes to avoid. Last verified October 2026.
Format · Affidavits · EWS and OBC-NCL
An EWS or OBC non-creamy-layer certificate can decide a seat or a job, and both rest on an income-and-asset self-declaration you swear to. Get the income figure, the family definition, or the asset limits wrong, and the certificate can be refused or cancelled later. This guide sets out the limits to check, gives a template for the declaration, and explains where to submit it and the mistakes to avoid. Last verified October 2026.
- What: a sworn self-declaration of family income and assets, supporting an EWS or OBC non-creamy-layer certificate.
- Income limit: Rs 8 lakh per year for both, but measured differently (EWS counts all income; OBC-NCL excludes salary and agriculture).
- EWS extra test: asset limits on land and property apply even if income is within the ceiling.
- Where: submit to the competent revenue authority (Tehsildar / SDM level), which issues the certificate.
01Why the self-declaration matters
The EWS and OBC non-creamy-layer certificates are issued by a revenue authority, but they rest on what you declare about your family’s income and assets. The affidavit is that declaration, made on oath.
Because it is sworn, a wrong or inflated declaration is not a small matter. A certificate obtained on a false declaration can be cancelled, and the benefit withdrawn, even years later. So the figures must be accurate and must match your supporting proof.
02EWS and OBC-NCL: the limits to check
Both schemes use an income ceiling of Rs 8 lakh per year, but they measure it differently, and the periods differ too. Verify the current figures before you file, because they are revised from time to time.
| Point | EWS | OBC non-creamy-layer |
|---|---|---|
| Income ceiling | Below Rs 8 lakh per year | Above Rs 8 lakh per year is creamy layer |
| What counts as income | All sources, including salary and agriculture | Excludes salary and agricultural income |
| Period looked at | Preceding financial year | Three consecutive years |
The EWS scheme also has asset limits (for example on agricultural land, residential flat size, and residential plot size), which disqualify a family even if income is within the ceiling. Last verified October 2026.
Income limit and asset limit are both tested
For EWS, staying under Rs 8 lakh is not enough on its own. The family must also be within the land and property asset limits. Check both before you declare.
03The template
Adapt this template for the self-declaration. Replace the text in square brackets, and follow the exact wording your state or the issuing authority prescribes where one is given.

04How to fill it, step by step
- State the category and purpose: EWS or OBC non-creamy layer, and the certificate you are applying for.
- Enter the income figure for the correct period: the preceding year for EWS, the last three years for OBC-NCL, counting income the way that scheme requires.
- Declare the asset position where the authority asks for it, especially for EWS.
- Include the false-declaration warning line, which most authorities expect.
- Attach proof: income proof, land or property records, and identity and category documents.
- Stamp, swear, and submit in the authority’s format.
05Where to submit it
The affidavit supports your application to the competent revenue authority, which issues the certificate. That authority is usually at the Tehsildar or Sub-Divisional Magistrate (SDM) level, though the exact designation varies by state.
Once issued, the certificate, supported by this declaration, is submitted to the college, university, or recruiter that requires it. Many states now issue these certificates online, with the affidavit or declaration uploaded as part of the application.
06Common mistakes
- Using the wrong income measure: counting salary or agricultural income for OBC-NCL when it is excluded.
- Using the wrong period: one year for OBC-NCL instead of three consecutive years.
- Ignoring the EWS asset limits while focusing only on income.
- Relying on an outdated income ceiling without checking the current figure.
- Declaring figures that do not match the proof, which can lead to cancellation.
- Missing the false-declaration warning or the verification clause.

09Frequently asked questions
What is the income limit for EWS and OBC non-creamy layer?
Both use a ceiling of Rs 8 lakh per year, but they measure it differently. EWS counts income from all sources, including salary and agriculture, for the preceding year. OBC non-creamy layer looks at three consecutive years and excludes salary and agricultural income. Verify the current figure before filing.
Is income the only test for EWS?
No. EWS also has asset limits, for example on agricultural land, residential flat size, and residential plot size. A family within the income ceiling can still be excluded if it exceeds the asset limits, so check both.
Who issues the EWS or non-creamy-layer certificate?
A competent revenue authority, usually at the Tehsildar or Sub-Divisional Magistrate level, though the exact designation varies by state. The affidavit supports your application, and the authority issues the certificate on the basis of your declaration and proof.
What happens if I declare the wrong figures?
A certificate obtained on a false or inflated declaration can be cancelled and the benefit withdrawn, even later, and it may attract penal action. The declared figures must be accurate and must match your supporting proof.
Where do I submit the affidavit?
With your certificate application to the competent revenue authority, and then the issued certificate goes to the college, university, or recruiter that requires it. Many states now accept the declaration online as part of the application.
Can Claw help with a reservation or certificate dispute?
Yes. If a certificate cancellation or a reservation claim reaches court, Claw tracks cases, orders and hearings across the 9,102 courts, benches and forums it covers, with results in under 5 seconds, so you can follow it by party or advocate name. It tracks and researches the case but does not give legal advice.
