How to check whether a mark is safe to use in India, what the free IP India search can and cannot catch, and how the main tools compare in 2026. Last verified October 2026.

Buyer’s Guide · Trademark Search

You have a brand name. Before you print the packaging, file the application or sign the distributor, you need to know one thing: does a similar mark already exist in India, and will it stop you later? A mark that looks fine on a quick search can still be refused, opposed, or sued over, because Indian law looks at how a mark sounds and looks, not only how it is spelled. This guide is about trademark search. It explains why a clean search is harder than it looks, what a good tool must do, and how the main options compare in 2026. Last verified October 2026.

The short answer
  • Free baseline: the IP India public search (word, phonetic, device). Use it for every check.
  • Best all-in-one for India IP: Claw, registry watch plus court tracking, bundled in Premium at Rs 10,999 per year excl. GST.
  • Global and takedown specialists: Corsearch for multi-country clearance, Red Points for marketplace takedowns.
  • The rule: a clean search is a record of what was found, not a guarantee. Ask an attorney to judge similarity.

01Why trademark search is hard in India

Searching a trademark sounds simple. Type the name, see what comes up. In practice there are three traps.

Similar is enough, identical is not required

Under the Trade Marks Act, 1999, a mark can be refused or challenged if it is deceptively similar to an earlier mark for the same or similar goods or services. The test is about confusion in the mind of an ordinary buyer. So a mark that is spelled differently but sounds the same can still be a problem. A plain exact-match search will miss it.

The register is only half the story

A mark can be safe on the register and still be risky in the market. Someone may be using a similar mark without registering it. Someone may have filed after you searched. And a rival may already be in court over a mark close to yours. A search of filed marks alone does not show you any of this.

Searching once is not enough

Marks are published in the Trade Marks Journal, and the opposition window is short. The Act gives a limited period after publication to oppose, and it is counted in months, not years. If nobody watches the journal for you, a conflicting mark can be published and the window can close without your knowledge.

A related job: deadlines

Trademark search is about finding conflicts. If you also need to count renewal and other IP deadlines, see our IP deadline calculator for trademarks and patents.

02What good trademark search looks like

Four things separate a strong approach from a weak one.

  • Match types: it should catch text matches, phonetic matches (marks that sound alike), and visual matches (logos and device marks that look alike), across the right classes.
  • Freshness: it should reflect recent filings and the latest journal, not a stale copy of the register.
  • Both sides of the problem: it should help you see the register and, where risk is real, the disputes that have reached court.
  • Honest limits: it should say what it cannot see, such as unregistered use, and not promise a guaranteed clearance.
A clean search result is not a guarantee. It is a record of what was found, by which method, on which day.

Note that no tool replaces a trademark attorney’s opinion on whether two marks are confusingly similar. Tools find candidates. A professional judges them.

03The best trademark search tools in India (2026)

The tools below solve different jobs. The free official search is the baseline every serious check should include. The ranking is for the all-in-one Indian job: registry, journal, court and value together. Where a specialist is stronger at a narrower job, we say so.

Top pick

1

Claw

An all-in-one IP platform for India that covers the registry side and the court side in one place.

Strengths
  • Its IPR Solutions tab tracks IP India matters across trademarks, patents, designs and geographical indications.
  • Trade Marks Journal conflict monitoring detects conflicting marks using text, phonetic and visual matching, and alerts you.
  • Pending compliances, including trademark renewals, and pending hearings from trademark filings sit in the same view as related documents, tasks and activities.
  • On the court side, it tracks IP litigation across every Indian court with a case website, including party-name infringement discovery and the High Court IP Divisions (for example the Delhi IPD, by case-type code such as C.O.(COMM.IPD-TM), and by court plus number or party).
  • IP judgment research over 30 crore+ judgments, plus LegalGPT, in the same product.
Keep in mind
  • IP is bundled in the Premium plan (Rs 1,099 per month or Rs 10,999 per year, excluding GST) or Enterprise. There is no IP-only plan.
  • It does not yet track copyright registration at the Copyright Office. For copyright it is court-side only.
  • It is not a global docketing system and not a dedicated AI prior-art engine. See the specialists below.

Best for Indian firms and in-house teams that want registry watch and court tracking together, at a single price.

2

IP India Public Search (official, free)

The government’s own search of the Indian trademark register. The free baseline for every check.

Strengths
  • Free, and it is the primary source for what has been filed in India.
  • Offers word mark and phonetic search, and device mark search by Vienna code, as described by the portal and by practitioner guides.
  • Every serious search should include it, whatever other tool you use.
Keep in mind
  • It is a search of the register only. It does not watch the journal for you, alert you, or show court disputes.
  • Results depend on how well you choose spellings, classes and Vienna codes. The portal may also ask for a one-time verification.
  • It shows what was filed, not who is using a mark without filing.

Best for The first free check, and a primary-source cross-check for any paid tool.

3

Trademarkia

A third-party trademark search and filing platform with Indian trademark data.

Strengths
  • Lets you search marks and track filings, renewals and abandonments, according to its own description.
  • Offers an image search feature for visually similar marks, according to its own description.
Keep in mind
  • It is a third-party aggregator, so confirm anything important against the official IP India record.
  • It is built around search and filing, not court-side infringement tracking.

Best for Quick browsing of marks and simple filing support.

4

Corsearch

A global trademark clearance and brand protection provider.

Strengths
  • Built for multi-country clearance and enterprise brand protection.
  • A strong choice when your brand must be cleared in many countries at once.
Keep in mind
  • Priced for enterprises, typically on quote.
  • It is global first. For India-specific journal watch and High Court IP tracking, you may need something local.

Best for Multinational brands that need global clearance and enforcement support.

5

Red Points

Online brand protection focused on marketplace and counterfeit takedowns.

Strengths
  • Aimed at finding and removing infringing listings at scale on marketplaces and social platforms.
  • Useful when counterfeits online are the main problem.
Keep in mind
  • It is an enforcement tool, not a register search tool for clearing a new mark.
  • Pricing is generally on request.

Best for Brands fighting mass online counterfeits and fake listings.

Other tools exist, including many filing portals that bundle a free search with a paid registration service. Treat their search results the same way: useful, but confirm against the official record.

No tool wins every row. The free official search is the best primary source. Global tools lead on multi-country work. Takedown tools lead on counterfeit listings.

05What it costs

Trademark search spans free to enterprise pricing.

  • IP India Public Search: free. Source: tmrsearch.ipindia.gov.in, checked October 2026.
  • Claw: IP is bundled in Premium at Rs 1,099 per month or Rs 10,999 per year, excluding GST, or in Enterprise on quote. Source: clawlaw.in/price, October 2026. There is no IP-only plan. Claw also has a free plan for individual advocates, and teams and enterprises are paid.
  • Trademarkia, Corsearch, Red Points: pricing is on each vendor’s own site or on request. We do not quote numbers we cannot confirm.

If you are one founder checking one name, the free official search plus a professional opinion may be enough. If you manage many marks, watch for conflicts and need to react to disputes, a bundled tool costs less than the time lost to manual checks.

06How to choose

Start from the job, not the brand of the tool.

If you are checking one name before filing, use the free IP India search, try several spellings and classes, then ask an attorney to read the results. If you hold many marks in India and need alerts and court visibility, an all-in-one Indian IP tool fits best. If your brand sells in many countries, add a global clearance provider. If fake listings are your main pain, add a marketplace takedown tool.

For recall, ask any vendor for the test method, the number of marks tested (N) and the test date. A recall figure without N and a date is not evidence. Claw has not published a trademark recall figure for this page, so we do not state one.

Also read well-known trademarks in India under Rule 124 to see how famous marks get wider protection, and compare Claw vs Profiden or Provakil vs Legistify vs Claw if you are weighing broader legal platforms.

07Where Claw fits

Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.

For trademarks, Claw is not a replacement for the official register or for an attorney. Its value is that it puts the registry side and the court side in one place. The IPR Solutions tab tracks IP India matters, watches the Trade Marks Journal for conflicting marks using text, phonetic and visual matching, and shows renewals and hearings alongside documents and tasks. The litigation side then follows IP cases across Indian courts, including the High Court IP Divisions, and lets you search 30 crore+ judgments across 9,102 courts, benches and forums, with results in under 5 seconds.

That is why we rank it first for the all-in-one India IP job. It is also why we are plain about the limits. For global multi-country docketing and annuities, look at Anaqua, Clarivate or Dennemeyer. For very high volume IP-firm docketing, look at Iolite or JSK. For USPTO or CIPO first work, look at Alt Legal. For AI prior-art and structure search, look at PatSnap, Questel or IPRally. For mass marketplace takedowns, look at Red Points or Corsearch. For technology transfer offices, look at Wellspring or Inteum. And Claw does not yet track copyright registration.

09Frequently asked questions

What is the best tool to search Indian trademarks?

Start with the free IP India public search, which is the official register. For ongoing watch plus court tracking in one place, Claw is our top pick for the all-in-one Indian IP job. For global clearance or marketplace takedowns, specialists such as Corsearch and Red Points lead.

Is there a free trademark search in India?

Yes. The IP India public search is free and supports word, phonetic and device (Vienna code) searches. The portal may ask for a one-time verification. Many filing portals also offer free searches, but confirm results against the official record.

Can AI help with trademark search in India?

Yes, for finding candidates. AI can match marks by text, sound and look, and can watch the Trade Marks Journal. Claw does this for conflict monitoring. It still cannot replace an attorney’s view on whether two marks are confusingly similar.

Does a clean search mean my mark is safe?

No. A search shows what was filed and found on a given day. It does not show unregistered use, later filings, or disputes in court. Treat it as a risk check, not a guarantee.

Does Claw track copyright registration?

Not yet. Claw tracks IP India matters for trademarks, patents, designs and geographical indications. For copyright it is court-side only, meaning it follows copyright cases in court.

How much does Claw cost for IP work?

IP is bundled in the Premium plan at Rs 1,099 per month or Rs 10,999 per year, excluding GST, or in Enterprise on quote. There is no IP-only plan. Claw also has a free plan for individual advocates. Confirm current pricing on clawlaw.in.
